Scalekrut (“Scalekrut,” “we,” “our,” and/or “us”) values the privacy of individuals who use our application, websites, and related services (collectively, our “Services”). Scalekrut  is a company registered and incorporated in India. We are committed to protecting and respecting your privacy. For the purposes of data protection legislation, we are the data controller and we will process your Personal Data in accordance with the IT Act, 2000(21 of 2000) and other national and state laws which relate to the processing of personal data. Please read the following carefully to understand our views and practices regarding your personal data and how we will treat it.

This privacy policy (the “Privacy Policy”) explains how we collect, use, and share information from users of our Services (“Users”). This Privacy Policy describes how we handle the information that you supply to us directly and through the Scalekrut platform, www.scalekrut.com website (“Scalekrut Sites”). By using our Services, you consent to such collection, use and sharing of information as described in this Privacy Policy and our Terms of Service. If you do not consent to the terms of this Privacy Policy and our Terms of Service, do not continue to interact with or use the Scalekrut Services.

In this Privacy Policy, “Personal Information” means any information related to an identified or identifiable individual, and does not include data whereby personally identifiable information has been removed (such as anonymous data). Please read this Privacy Policy carefully so that you understand your rights in relation to your personal information, and how we will collect, use and process your personal information. If you do not agree with this Privacy Policy, our Terms of Service or any part thereof, you should not access or use any part of our Services, or otherwise provide us with your personal information. Scalekrut is the entity responsible for the processing of your personal information, and for the purpose of the European Union’s General Data Protection Regulation, is the data controller in respect of the processing of your Personal Information. Where we have an arrangement in place with a customer who is encouraging you to use our Services (for example, your employer or another business or organization), we in some circumstances obtain and process your personal information on behalf of and at the instructions of such a customer. Such customers will be considered as the data controllers under the European Union’s General Data Protection Regulation. Their privacy policies will apply to the processing of your information and we encourage you to read their privacy policies.

Our Privacy Policy and Terms of Service apply to any User of our Services.

  1. DATA COLLECTION

When you use our Services, we automatically collect personal information about your device and how you use our Services. In the course of providing the Services to you, we may collect a variety of information from or about you or your devices from various sources, as described below:

  • Registration, purchase and use of Scalekrut Services: Information such as name, email address, telephone number, company/organization, financial information, and other information, may be collected in connection with registration for, purchase of or use of Scalekrut Services (for example, to sign-up for and log into Scalekrut Services). Customers may update their information by logging into their account. Information may also be collected to track license use.
  • Communications: Personal information such as name, email address, and other information, may be collected, when provided in any communications, whether via email, social media, telephone or otherwise.
  • Support: Personal information may be collected in connection with customer support, whether via screensharing, email, social media, telephone or otherwise.
  • Surveys and Research: We may collect personal information from anyone participating in research and surveys.
  • User Comments and Content: If you post any comments or content on our website, you should be aware that any personally identifiable information you choose to provide there may be read, collected, or used by third parties. We are not responsible for the information you choose to submit and we cannot guarantee that third parties have not made copies of or will not use such information in any way

We may receive additional information about you, such as demographic data, from third parties such as data enrichment partners and combine it with other information we have about you.

We use the information we collect:

  • To provide, maintain, improve, and enhance our Services;

  • To fulfill customer requests, such as to create a Scalekrut Services account or complete customer purchases.

  • To send customers information regarding  Scalekrut Services and issues specifically affecting Scalekrut Services.

  • To support and personalize our Services, websites, mobile services, and advertising.
  • In the case of server logs, to help us statistically monitor how many people are using our site and for what purpose.
  • To protect the security and integrity of our Services, content, and our business.
  • To the extent permitted by applicable law, we may use, process, transfer, and store any data about individuals and customers or partners in an anonymous (or pseudonymous) and aggregated manner. We may combine personal information with other information, collected online and offline, including information from third party sources. We may also use information in other ways with consent or as permitted by applicable law. By using Scalekrut Services, our customers agree that we are hereby licensed to collect, use, share and store anonymized (or pseudonymized) aggregated data collected through Scalekrut Services for benchmarking, analytics, A/B testing, metrics, research, reporting, machine learning and other business purposes.
  • To meet our contractual requirements, to comply with applicable legal or regulatory requirements and our policies, and to protect against criminal activity, claims and other liabilities.
  • For any other lawful purpose for which the information is provided.
  • For marketing and advertising purposes, such as developing and providing promotional and advertising materials that may be relevant, valuable or otherwise of interest to you;
  • To generate anonymized, aggregate data containing only de-identified, non-personal information that we may use for any purpose;
  • To find and prevent fraud, and respond to trust and safety issues that may arise;
  • For other purposes for which we provide specific notice at the time the information is collected.
  • If you are in the European Economic Area or the UK, we only process your personal information when we have a valid legal basis.
  • We may use your personal information when you have given your consent to do so.
  • We may use your personal information to perform our end of our contracts with you. For example, to provide you with the Services.
  • We may use your personal information when we are legally required to. For example, to comply with tax and accounting obligations, or to comply with a court order.
  • We may use your personal information when we, or a third party, have a legitimate interest in doing so. For example, we have a legitimate interest in understanding usage and improving the Services. We only rely on our or a third party’s legitimate interests to process personal information when these interests are not overridden by your rights and interests.

CUSTOMERS: We may share information with our customers and their service providers and other platforms that may assist those customers

 VENDOR AND SERVICE PROVIDERS: We may share any information we receive with vendors and service providers retained in connection with the provision of our Services.

ADVERTISING AND MARKETING: We do not rent, sell, or share information about you with nonaffiliated companies for their direct marketing purposes, unless we have your permission. To the extent permitted by applicable law, we may share information with third parties for marketing, advertising, promotions, contests, or other similar purposes. For the avoidance of doubt, the disclosure of your information may occur if you post any objectionable content on or through the Services. We may also share information if, in our sole discretion, we believe disclosure is necessary or appropriate to protect the rights, property or safety of any person, or if we suspect fraud or other illegal activity

MERGER, SALE, OR OTHER ASSET TRANSFERS: We may transfer your information to service providers, advisors, potential transactional partners, or other third parties in connection with the consideration, negotiation, or completion of a corporate transaction in which we are acquired by or merged with another company or we sell, liquidate, or transfer all or a portion of our assets. The use of your information following any of these events will be governed by the provisions of this Privacy Policy in effect at the time the applicable information was collected.

Scalekrut may also disclose personal information for other purposes or to other third parties when an individual has consented to, or requested, such disclosure, or where a customer has obtained permission from such individual, or where such disclosure is otherwise legally permitted for legitimate business purposes, and, for customer data, with such customer’s authorization or otherwise in accordance with Scalekrut’ agreement with such customer.

  1. DATA SECURITY

We make reasonable efforts to protect your information by using physical and electronic safeguards designed to improve the security of the information we maintain. However, as no electronic transmission or storage of information can be entirely secure, we can make no guarantees as to the security or privacy of your information. We use reasonable safeguards to protect the information we collect, but we cannot guarantee the security of your information.

  1. INTERNATIONAL VISITORS AND CROSS BORDER DATA TRANSFERS

The Scalekrut Services may be provided using resources and servers located in various countries around the world, including the United States and other countries. Therefore, personal information about individuals or customers may be transferred, processed and stored outside the country where Scalekrut Services are used, including to countries outside the European Union (“EU”), European Economic Area (“EEA”) or Switzerland, where the level of data protection may not be deemed adequate by the European Commission.

We may transfer your data from the U.S. to other countries or regions in connection with storage and processing of data, fulfilling your requests, and operating the Services. By providing any information, including personal information, on or to the Services, you consent to such transfer, storage, and processing.

When we transfer your personal information outside of the European Economic Area, including to the U.S., we shall ensure that relevant safeguards are in place to afford adequate protection for your personal information in compliance with relevant data protection laws. To the extent required by applicable law, or in our discretion otherwise, we will allow customers and individuals to limit use of personal information. If at any time after providing us with your personal information such information changes or you change your mind about receiving information from us, you may request access to your data or that your data be changed.

You may withdraw any consent you previously provided to us regarding the processing of your Personal Information, at any time, and free of charge. We will apply your preferences going forward and this will not affect the lawfulness of the processing before you withdrew your consent.

Please note that, prior to any response to the exercise of such rights, we will require you to verify your identity. Our Services may contain links to other websites, products, or services that we do not own or operate. We are not responsible for the privacy practices of these third parties. Please be aware that this Privacy Policy does not apply to your activities on these third party services or any information you disclose to these third parties. We encourage you to read their privacy policies before providing any information to them.

We are not responsible for the privacy practices of third party websites, products, or services that may be linked on our Services.

  1. CHILDREN UNDER 16

We do not knowingly collect, maintain, or use personal information from children under 16 years of age, and no part of our Services is directed to children. If you learn that a child has provided us with personal information in violation of this Privacy Policy, then you may alert us at privay@scalekrut.com.

Our Services are not intended for children under 16.

 

  1. DATA RETENTION

We store all personal information for as long as necessary to fulfil the purposes set out in this Privacy Policy, or for as long as we are required to do so by law or in order to comply with a regulatory obligation. When deleting personal information, we will take measures to render such personal information irrecoverable or irreproducible, and the electronic files which contain Personal Information will be permanently deleted.

We only store your personal information for as long as necessary and we take measures to render the information irrecoverable once deleted.

  1. CHANGES TO THIS PRIVACY POLICY

We will post any adjustments to the Privacy Policy on this page, and the revised version will be effective when it is posted. If we materially change the ways in which we use or share personal information previously collected from you through the Services, we will notify you through the Services, by email, or other communication.

Changes to this Privacy Policy apply to your use of our Services after the “last updated” date, at the top.
